AN ORDINANCE

That the Zoning Ordinance of the City of Cambridge be amended on a Zoning Petition by the Cambridge City Council to amend the Cambridge Zoning Ordinance in Article 11.000 with the intent to amend a subsection of the Cannabis Uses standards, Section 11.800 of the Cambridge Zoning Ordinance, with the intent to remove the provision that prohibits the packaging or repackaging of cannabis products on the premises of a Cannabis Retail Store as follows:

11.803.1 Cannabis Retail Stores.

(a)

Cannabis Retail Stores shall be allowed only in those districts set forth in the Table of Use Regulations (Section 4.30 of this Zoning Ordinance) and special districts and overlay districts whose use regulations are based on those districts, subject to any limitations set forth in the regulations of those districts. In the Business A-1 district, only applicants that have been designed as Economic Empowerment Applicants or certified as eligible to participate in the Social Equity Program by the Massachusetts Cannabis Control Commission may be permitted and such designation or eligibility shall be maintained.

(b)

A Cannabis Retail Store shall not be permitted within one thousand and eight hundred (1,800) feet of another Cannabis Retail Store, except if the applicant has been designated as an Economic Empowerment Applicant or certified as eligible to participate in the Social Equity Program by the Massachusetts Cannabis Control Commission and maintains that designation and/or certification.

NOTICE OF PUBLIC HEARING

The Planning Board of the City of Cambridge will hold a public hearing on Tuesday, July 8, 2025 at 6:30 p.m.

Opened on May 20, 2025 located at Remote participation on Zoom (see details below) on a Zoning Petition by Mushla Marasao, et al., to amend the Cambridge Zoning Ordinance in Sections 5.28.21, 8.22.1, 8.22.2, and Table 5.1 with the intent to Remove gross floor area (GFA) and floor area ratio (FAR) limitations for religious uses, permit conforming additions to nonconforming structures without limitation for religious uses, and permit religious uses with the same dimensional limitations as residential uses except that in a Residence C-1 district permeable open space would not be required, buildings would be permitted up to 6 stories and 74 feet above grade without meeting inclusionary housing requirements, and buildings taller than 35 feet and 3 stories above grade would not be required to notify neighbors and hold a meeting.

In amendment to the Ordinance entitled โ€œCambridge Municipal Codeโ€

That the Municipal Code of the City of Cambridge be amended in Chapter 5.50 Cannabis Business Permitting with the intent of: (1) adding a new definition for โ€œRegistered Marijuana Dispensary (RMD) or โ€œMedical Marijuana Treatment Center (MTC)โ€, (2) revising the applicability of the ordinance to now apply to any proposed Cannabis Business seeking licensure from the Massachusetts Cannabis Control Commission, (3) clarifying the timelines for the issuance of Cannabis Business permits, (4) clarifying and revising permitting requirements in order to obtain a Cannabis Business permit pursuant to the ordinance, (5) removes the annual submission requirements of an Operations and Logistics Plan for approval by the Cambridge Transportation Department and Cambridge Police Department. (6) revises packaging requirements for Cannabis Retail Stores, and (7) revising other parts of the ordinance for internal consistency.
