ROOFTOP RIGHTS FOR WIRELESS EQUIPMENT ROOFTOP SPACE

The Cambridge Housing Authority (CHA), as Agent for Truman Apartments LLC (CHA) is seeking an Offeror(s) for a lease for specific roof rights at Truman Apartments. The rapid growth of the wireless communication industry has resulted in an increased need for strategically located tall structures as antenna sites. As the owner of several midrise and high-rise housing structures throughout the city as well as low-rise buildings with flat roofs, the CHA hopes to generate revenue by providing rooftop space to the wireless communications industry.

The selected Offeror(s) will lease the exclusive or non-exclusive rights to designated roof location(s). It will also be the Offeror’s responsibility to manage the site in a mutual agreement between the Offeror(s) and the Cambridge Housing Authority on behalf of the owner of the property.

The scope of services will include, but not be limited to, Offeror(s) will be responsible for the installation, maintenance, administration and security of the antenna site(s).

The Offeror(s) agree that they will cooperate with the CHA and other Offeror(s) and/or existing lessors in achieving the maximum utilization of space without causing interference to existing installations.

The Offeror(s) shall be prepared to provide independent architectural and structural engineering certification that any and all modifications to the structure will meet all Commonwealth of Massachusetts Building Codes and be visually acceptable to the CHA. The Offeror(s) shall prepare and submit two sets of scaled drawings 24” x 36.

Bids are subject to M.G. L. Chapter 30B. This lease will be for ten years with two renewable 5 year terms at the sole discretion of the CHA. CHA may, at their sole discretion, use a third party to help evaluate the proposals.

This notice shall satisfy two separate but related procedural requirements for activities to be undertaken by Massachusetts Housing Partnership (MHP).

REQUEST FOR RELEASE OF FUNDS

On or about March 8, 2025, MHP will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of HUD Federal Financing Bank Treasury Risk Share to be utilized for a project known as 4 Mellen, located at 4 Mellen Street, Cambridge, MA. The subject property includes a historic 3-story office building and parking lot. The proposed activities include adaptive reuse of a historic mansion into 4 residential units and the addition of a new construction 25-unit apartment building. The City of Cambridge recently designated the property, including the historic building and new construction, a Local Landmark.

Given the historic nature of the building as it was constructed in 1862, both lead based paint and asbestos containing materials are likely present and will need to be abated in all areas of disturbance and disposed of appropriately as required by state and federal laws. Post-renovation/construction radon testing and mitigation, as necessary, is recommended. Local tribes have been informed of the proposed project and no responses were received, implying the end of the tribal consultation process.

The total estimated project cost is approximately $26,011,780 and of that the risk share loan will be approximately $4,970,000. Public notification for other federal funds used at the site have been published separately.

FINDING OF NO SIGNIFICANT IMPACT

MHP has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at MHP, 160 Federal Street, Boston, MA 02110. The ERR may be examined or copied at this location weekdays from 9am to 4pm or via email at dkamma@mhp.net.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to MHP, 160 Federal Street, Boston, MA 02110 or via email at dkamma@mhp.net . All comments received by March 7, 2025 will be considered by MHP prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.

ENVIRONMENTAL CERTIFICATION

MHP certifies to HUD that Clark Ziegler in his capacity as Executive Director, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certifications satisfies its responsibilities under NEPA and related laws and authorities, and allows the project to use HUD program funds for the purpose specified.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of funds and MHP’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Executive Director of MHP; (b) MHP has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the HUD Director of Community Planning and Development at CPDRROFBOS@HUD.gov for the Risk Share funds. Potential objectors should contact the CPD Director at HUD Boston to verify the actual last day of the objection period.

Every dog six months old or over shall be licensed pursuant to G.L. c. 140, § 137. As proof that the dog has been spayed or neutered, the owner or keeper shall present to the Director of the Animal Commission (“Director”) or his or her designee a certificate of the registered veterinarian who performed the operation. Effective February 10, 2025, the fee for such license shall, except as otherwise provided, be twenty dollars for a spayed or neutered dog and thirty dollars for a dog that is not spayed or neutered. If the Director or his or her designee is satisfied that the certificate of the veterinarian who performed the operation cannot be obtained, he or she may accept in lieu thereof a sworn statement of a veterinarian registered and practicing in the Commonwealth, describing the dog, and stating that he or she has examined the dog and that, in his or her opinion, it has been spayed or neutered. Pursuant to G.L. c. 140, § 139, no fee shall be charged for a license issued under this section for a service animal as defined by the Americans with Disabilities Act or regulations promulgated thereunder or for dog owners aged 70 years or older. No part of the fee shall be refunded because of the subsequent death, loss, spaying, castration, removal from the Commonwealth or other disposal of the dog. Nor shall any part of the fee paid by mistake be refunded.
